Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of VitalJobs.ICU (the "Service"), operated by VitalJobs.ICU ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the Service.

Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

• Maintain and update your information as needed
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Post false, misleading, or fraudulent job listings or applications
• Harass, abuse, or harm other users or engage in discriminatory practices
• Transmit viruses, malware, or other harmful code
• Scrape, harvest, or collect data from the Service without permission
• Impersonate any person or entity or misrepresent your affiliation
• Interfere with or disrupt the Service or servers
• Use automated systems (bots) to access the Service without authorization
• Post spam, unsolicited advertisements, or promotional content

Job Seekers

If you are using the Service as a job seeker, you agree to:

• Provide truthful and accurate information in your profile
• Respect employer requirements and application procedures
• Not share your account credentials with others

VitalJobs.ICU is a job discovery platform. When you click "Apply" on a listing, you are redirected to the employer's own application page. We do not process or store your job applications, resumes, or cover letters. We do not guarantee job placements, interviews, or employment outcomes.

Employers and Job Postings

If you are posting jobs on behalf of an employer, you agree to:

• Have the authority to post jobs on behalf of your organization
• Post only legitimate, active job opportunities
• Provide accurate job descriptions, requirements, and compensation information
• Comply with all applicable employment laws and regulations
• Not discriminate based on race, color, religion, sex, national origin, age, disability, or other protected characteristics
• Handle applicant information confidentially and responsibly
• Not use the Service to collect resumes for purposes other than hiring

We reserve the right to review, edit, or remove job postings that violate these Terms or our content policies.

Payment and Refunds

Employers must pay applicable fees to post job listings. By purchasing a job posting, you agree to:

• Pay all fees associated with your selected plan
• Provide accurate billing information
• Authorize us to charge your payment method

We offer a 7-day money-back guarantee for job postings. Refund requests must be submitted within 7 days of purchase. Refunds are not available after the 7-day period or if the job posting has been live for more than 7 days.

All fees are non-refundable except as stated above or required by law.

Intellectual Property

The Service, including its design, code, content, and trademarks, is owned by VitalJobs.ICU and protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit (resumes, job postings, etc.), but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content as necessary to operate the Service.

User Content

You are solely responsible for content you post on the Service. We do not endorse, verify, or guarantee the accuracy of user-submitted content.

We reserve the right (but not the obligation) to monitor, review, edit, or remove content that violates these Terms or is otherwise objectionable.

AI and Automated Processing

We use artificial intelligence to process, classify, and enrich job listing content provided by employers and job sources. This automated processing helps ensure listings are accurate, consistently formatted, and properly categorized.

While we strive for accuracy, AI-generated classifications (such as ICU type, salary estimates, and job summaries) may contain errors. We encourage users to verify details directly with the employer. VitalJobs.ICU is not responsible for inaccuracies resulting from automated processing.

Third-Party Services and Links

The Service may contain links to third-party websites or integrate with third-party services (e.g., payment processors, applicant tracking systems). We are not responsible for the content, policies, or practices of third-party services.

Your use of third-party services is subject to their terms and policies.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy, completeness, or reliability of any content on the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITALJOBS.ICU AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify, defend, and hold harmless VitalJobs.ICU and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to the Service

Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, including if you violate these Terms.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

Sections of these Terms that by their nature should survive termination will survive, including provisions related to intellectual property, disclaimers, and limitations of liability.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VitalJobs.ICU regarding the Service and supersede any prior agreements.
